FSSAI Registration / License

Overview

FSSAI registration or license is mandatory for everyone involved in the food business, be it café services, restaurant services, export of food items, food processing, food manufacturing, packaging, trading, distribution, wholesale, storage, retail, dairy business etc you must acquire Fssai License or registration as applicable.

FSSAI Food safety Registration is mandatory for anyone who intends to do food business. This not only involves preparing food but everyone who handles food at various stages before it ultimately reaches the customer like raw materials, manufacturing, processing, Mess, Canteen packing and the distribution as well as the agencies who have authority to sell them.

In other words, an individual or a company that operates with food substances from farm to plate must obtain the FSSAI food licence.

The registration/licence is issued by the Food Safety and Standards Authority of India (FSSAI), an institution that monitors food businesses under the guidelines and regulations listed in the FSSAI Act 2006.

TYPES OF REGISTRATION

Basic Registration: Fssai Basic registration is applicable on sole proprietor, small businesses, having annual turnover below INR 12 Lakhs. As operations scale up and turnover reaches Rs. 12 Lakhs mark, the basic registration will need to be upgraded to state or central license, as applicable. As the name suggest, it is very basic registration, which is for small businesses and is valid in limited area of operations and for limited Kind of Businesses.

State License: Food Businesses having annual turnover between INR 12 Lakhs to INR 20 crores (up to INR 30 crores in some cases) can apply for FSSAI state license. Food business operators like small to medium-sized manufacturers, storage units, Transporters, Retailers, Restaurants Marketers, distributors etc. are however required to obtain the FSSAI State License Registration. Note: For state license there can be other conditions as well, like capacity in Metric tonnes, in number of vending machines, in number of operating vehicles etc.

Central License:  Food Businesses having annual turnover above INR 20 crores or above, must apply for FSSAI central license. Eligible food Business Operators like Importers, seller of proprietary food items, manufacturers, operators in central government, railways, airports, seaports, etc. need to take a Central FSSAI license from Food Standards and Safety Authority of India. Note: For Central license there can be other conditions as well, like capacity in Metric tonnes, in number of vending machines, in number of operating vehicles, selling through e-commerce etc.

Who is required to Apply for FSSAI License?

From street hawkers, road side stalls, home vendors to medium businesses, hotels, restaurants, road side dhaba to giant food chains, railways, airplanes, everyone operating in the food industry needs to register with FSSAI. Irrespective of whether you are operating online or offline, or whether you are a local player or into the import or export of food products, you need to register with FSSAI. Based on their size and the places they operate; they have to get one of the 3 types of registration/license discussed above.

If your business falls in any one of the below-listed categories (also known as Kind of Business or KOB, then a food licence is mandatory for you:

Manufacturer of: Dairy units, Vegetable oil and processing units, Slaughtering units, Meat processing units, Food or Health Supplements and Nutraceuticals etc., General Manufacturing, Proprietary Food, Non-specified food and food ingredients, Substances Added to Food, Radiation Processing of Food, 100 % Export Oriented units, exporters.

Trade/Retail: Storage, Wholesaler, Distributor, Transportation, Retailer, Food Vending Agencies, Importer, e-Commerce, Trader/Merchant.

Food Services: Petty Retailer of snacks/tea shops, Hawker, Mobile food vendor, Restaurants, Food Vending Establishment, Club/Canteen, Caterer, Hotel, Mid-Day meal – Caterer, Mid-Day meal – Canteen.

Documents required for FSSAI Registration.

Based on different types of registration and the food business that you are running, you have to submit different documents for registration.

Basic Registration Requirements

  • Authorized person’s passport-sizes photograph [self-attested]
  • Authorized person’s Aadhar card front and back [self-attested]
  • Address proof of the business premises [rental agreement/previous month’s electricity bill/NOC from landlord]
  • Declaration signed by the authorized person

State & Central Licence – General Requirements

  • Phone No., Email, Address of directors/partners/proprietor
  • Identity proof of directors/partners/proprietor (copy of Aadhaar and PAN)
  • Address proof of the business premises (rental agreement/latest electricity bill/consent letter from landlord)
  • Photograph of the premises (at least 5-6)
  • Recall Plan
  • FSMS Plan
  • Form IX and Board Resolution (format to be provided by Startup Sampark)

State & Central Licence – Requirements on case to case basis

  • Water test report
  • List of machines, along with details and pictures
  • Blueprint of the premises
  • Latest audited financials
  • Declaration in respect to turnover or number of operating vehicles
  • Other declarations, as required, from case to case basis.

What is the validity of FSSAI registration?

FSSAI licenses or registration issued to food businesses are valid for a period of 1 to 5 years (as applied for).

It is mandatory to apply for licence renewal 30 days before the expiry of the existing licence. Non-renewal of licences can fetch a fine of ₹100 per day until the renewal is done.

The government fee for Basic registration is INR 100/annum. For State license the government fee ranges from 2000/annum to 5000/annum. For Central license the government fee is 7500/annum. Maximum can be applied for 5 years.
